The question of whether carrying guns is necessary for protection in New York City has been a subject of much debate. While the city has stringent gun control laws, many individuals argue that self-defense requires the ability to protect oneself at all times.

Why Carrying Guns May Be Necessary

Consider the following facts that support the necessity of carrying firearms for personal protection:

Law Enforcement Jurisdiction and Duties

In New York City, as well as in other areas, law enforcement personnel are equipped with firearms. However, it is essential to recognize that they have a limited duty to protect individuals. The 1981 case Warren v. District of Columbia by the D.C. Court of Appeals determined that police officers have a general duty to protect individuals only under certain circumstances, not as a matter of course.

This means that if a crime occurs, law enforcement will respond to investigate and potentially make an arrest. Their primary responsibility is to intervene after the incident, rather than proactively protect individuals at all times. Thus, it is reasonable to conclude that individuals must take personal responsibility for their safety.

Personal Experience and Caution

I hold a license to carry a concealed handgun in 36 states, including New York State. I find that I rarely leave home without a firearm because I believe it provides a crucial layer of protection. My New York permit is valid for 57 counties outside the city but not within the five boroughs of New York City. This limitation has led me to refuse visiting my son and his family on the Upper East Side of Manhattan.

As recent events have demonstrated, being able to defend oneself and one's family is wise and important.

Notably, even recent Supreme Court decisions have ruled certain NYC gun control laws unconstitutional. However, the current governor of New York has shown reluctance to honor these rulings, with NYC issuance of carry permits being extremely selective and often reserved for those with connections to power.

One recent example highlights the pivotal role of a firearm in personal safety. A man traveling in the NYC subway was able to save a woman who was being beaten and robbed by a criminal with the aid of his firearm. Unfortunately, the man faced multiple firearm violation charges and significant legal fees following his intervention.

These events underscore the ongoing debate around individual vs. public safety, and the potential benefits and risks associated with carrying guns. While relocation from New York City 20 years ago provided me with the peace of mind to move forward without regret, the issue remains a modern dilemma for many residents and visitors alike.

Ultimately, the decision to carry a firearm for protection is a personal one that should be carefully considered based on individual circumstances and laws in one's area.
